In Massachusetts there are two types of custody: legal custody and physical custody. In many cases, parents are granted joint legal custody. This gives them shared responsibility for making decisions related to their children's education, health, medical care, and religion. Even in cases involving joint legal custody one parent is typically granted physical custody. However, under the right circumstances, joint physical custody is a possibility. The custodial parent is almost always paid child support by the non-custodial parent.

Massachusetts child support guidelines provide parents with a guide for determining the levels of support for their children. However, there are many factors considered when making child support decisions:

  • Separate alimony or maintenance payments
  • Custody and visitation
  • Age of the children
  • Health insurance, uninsured, and extraordinary medical expenses
  • Attribution of income
  • Prior orders for support
  • Expenses of subsequent families

Keep in mind, however, that state guidelines are not designed for high income individuals or families. In cases where family income exceeds $135,000 or a non-custodial parent's income exceeds $100,000, the courts are granted broad discretion to grant child support that is in the interest of the couple's children.
