Workers' Compensation

Experienced Boston Workers' Compensation Attorneys

Workers' compensation often -- referred to as workers' comp or workman's comp, is a benefit paid to workers injured on the job. Massachusetts law requires employers to carry workers' compensation insurance coverage. However, since claims are one of the factors in determining premium levels, employers and insurers often deny claims. At Cosgrove, Eisenberg & Kiley, P.C., we are committed to helping injured workers obtain fair compensation for workplace injuries.

You are entitled to compensation for disabilities resulting from on the job injuries. Workers' compensation provides these benefits, regardless of who was at fault in the accident. It also prevents you from suing your employer for negligence. But it does not prevent lawsuits for injuries caused by third parties, including accidents involving sub-contractors and car accidents that can occur while working. Our ability to handle workers' compensation claims as well as personal injury litigation allows us to effectively manage both cases to your greatest benefit.

Under Massachusetts workers' compensation law, an injured or disabled worker is entitled to:

  • 100% of medical bills paid (when treatment is provided by an authorized doctor);
  • 60% of weekly wage (while taken out of work by a doctor's order);
  • Additional compensation for injuries causing partial disability or total disability.
  • Compensation for disfigurement and loss of function

We have successfully represented clients seeking compensation for work site injuries, construction accidents, repetitive stress injuries, and industrial diseases. We have the skill and experience to handle your workers' compensation matter whether you are seeking temporary total incapacity benefits, partial incapacity benefits, permanent and total incapacity benefits, or permanent loss of function and disfigurement benefits. In addition, we have experience representing clients in many different procedural settings: including conciliation, arbitration, administrative hearings, appeals, and in lump sum settlement negotiations.

We have many years of experience handing personal injury and workers' compensation matters. Let us put our tradition, insight, and experience to work for you.
